Terms of Service

These Terms of Service govern access to and use of the DestyFinder platform available at www.destyfinder.com (hereinafter: the "Platform"). By using the Platform, you accept these Terms in full.

1. What is DestyFinder

DestyFinder is an online platform that connects travelers with local tourist agencies, guides, and experience providers in Montenegro. The Platform allows searching and browsing offers, as well as sending inquiries directly to an agency.

DestyFinder is not a party to the tourist service contract. The contract for organizing the tour, payment, cancellation, and any other service relationship is concluded directly between the traveler and the agency. DestyFinder only mediates in establishing contact and is not responsible for the execution of the tour.

2. Registration and account

Registration is free. To open an account, you enter an accurate and up-to-date email address. Keep your password confidential. You are responsible for all activity carried out through your account.

We reserve the right to suspend or delete an account that violates these Terms, jeopardizes the security of the Platform, or harms other users.

3. Traveler obligations

• When sending an inquiry, enter accurate details (name, email, phone).
• Do not send spam inquiries, automated messages, or offensive content.
• Arrange tour details (price, payment, cancellation) directly with the agency.
• Make payments exclusively to the agency, on their terms. DestyFinder does not receive or mediate payments.

4. Agency obligations

• Data about the agency and tours must be accurate, up to date, and consistent with the actual offer.
• You may not publish tours that are not part of your offer, nor take over the content of other agencies.
• Prices listed on the Platform must be final for the displayed configuration (per person, GROUP/PRIVATE).
• Hidden fees are not allowed.
• Inquiries are answered within a reasonable time, with a recommendation of within 24 hours.
• You hold all the necessary permits and licenses to provide services in Montenegro.
• DestyFinder reserves the right to remove tours that violate these Terms or compromise the quality of the Platform.

5. Service fee

Use of the Platform is free for both travelers and agencies. We do not take a commission on the tour and do not mediate payments between traveler and agency.

6. Intellectual property

The logo, design, text, and technical solutions of the Platform are the property of DestyFinder. Content published by agencies (images, descriptions, agency logos) remains the property of the agency, but they grant us a limited right to display it on the Platform and in the Platform's promotional materials.

7. Disclaimer of liability

The Platform is provided "as is". We do not guarantee continuous availability, the absence of errors, or the accuracy of data published by agencies.

DestyFinder is not liable for damage arising from the contractual relationship between the traveler and the agency, including but not limited to tour quality, activity safety, cancellations, injury, lost luggage, delays, weather conditions, or failure to honor agreed terms.

8. Changes to the Terms

We update the Terms from time to time. We publish material changes on this page and, if you have an active account, send a notification by email at least 14 days before they take effect.

9. Governing law and jurisdiction

The law of Montenegro applies to these Terms. We resolve disputes by attempting an amicable agreement. If an amicable solution is not possible, the court in Podgorica has jurisdiction.
